Why is it necessary to register your land?
Proof of ownership is obtained by registration. It serves as a public confirmation that you are the owner of the land.
There are two land registration systems in Ghana.
1. The Land Title Registration
2. The Deeds Registration System
Only locations designated as Registration districts are subject to Land Title Registration.
Only the Greater Accra Region and Kumasi’s inner city are currently registration districts.
The Deeds Registration System is used in all other places.
So, essentially, what applies to you is determined by the location of your property.
Cost and registration
The registration of land titles takes longer than the registration of deeds.
Getting a property registered takes roughly two and a half months, providing there are no other complications
The cost of completing the registration process is around 1.2 percent of the value of your property.
There is a significant distinction between Deeds Registration and Title Registration.
The Deed registration
This process registers the document that transferred the land to the purchaser, i.e the indenture and not the land per se or the interest being purchased
With the deed registration, there can be multiple registration of documents transferring the same parcel of land by different entities or people
The title registration
This process deals with the registration of the land itself or the title being purchased. The title registration provides protection or security for one’s interest than deed registration.
Allodial interest
This is the greatest level of land interest. All rights are subsets of the allodial interest. It is usually owned by collective entities.
Freehold interest
Entities with allodial interest give an individual and his legitimate successors the right to occupy and use the land. The individual is not the absolute owner even though they cannot be sacked from the land. So far as the terms and conditions have been met, they own it into perpetuity
Leasehold interest
It’s a type of land interest that’s designed to last a set amount of time. It could be given by the allodial interest holder or the freeholder. Because this is a revocable interest, it’s critical to know when it starts and when it ends.
For residential purpose, you can have up to 99 years.
Foreigners can own land in Ghana for up to 50 years. They cannot be freeholders.
