Terms and Conditions

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Ghana Property Listing of P.O.Box AC 458 Arts – Centre Accra – Ghana (“we,” “us” or “our”), concerning your access to and use of the www.ghanapropertylisting.com Website (“Website”).

1. Validity of these Terms and Conditions
  1. Ghana Property Listing (hereinafter referred to as “ghanapropertylisting.com”) operates the internet portal ghanapropertylisting.com and makes the services offered on this portal available to users on the basis of the following Terms and Conditions.
  2. For the individual services, there may be in some cases special Terms as well as admission guidelines which apply in addition to these Terms and Conditions and take precedence in the event of a conflict.
2. Access to the services
  1. In principle, all users are entitled to access and participate.
  2. All persons who have reached the age of 18 or can prove a declaration of consent from a parent or legal guardian are eligible to use the services.
3. Registration of a user account
  1. For certain services on the ghanapropertylisting.com pages, the user must register or can open a user account. 
  2. The user warrants that the personal details provided by him/her in the course of registering or opening a user account on the ghanapropertylisting.com pages, in particular his/her first name, surname and postal address as well as phone number and e-mail address, are true and correct and that he/she will notify ghanapropertylisting.com immediately of any changes to the details provided.
  3. If the user orders a newsletter when registering, ghanapropertylisting.com is entitled to send him/her e-mails containing news and interesting offers to the e-mail address provided by the user, provided that these offers relate to the newsletter ordered. 4. Content provided by the user
  1. The user who sends his/her own content (e.g. videos, photos, photo series, texts, etc.) to ghanapropertylisting.com declares by submitting the content that he/she agrees that the submitted content may be reproduced, disseminated and publicly reproduced free of charge on the Internet and in print. Furthermore, the user declares that he/she owns all copyrights and other rights to the submitted content and that persons depicted in the submitted graphic content (e.g. videos, photos, photo series), who are not merely accessories to a location or part of the depicted meetings, processions or similar events, agree to the publication. For persons under 18 years of age, the consent of the parent or guardian shall apply. Contributions sent by post cannot be returned to the participant.
  2. The user undertakes not to send any content to ghanapropertylisting.com that is illegal, grossly offensive, pornographic or sexual, harmful to minors, extremist, glorifies or trivialises violence, glorifies war, promotes a terrorist or extremist political organisation, incites a criminal offence, contains defamatory statements or any other criminal content.
  3. ghanapropertylisting.com reserves the right not to publish submitted content. The user has no legal claim to publication of the submitted content.
  4. The user shall indemnify ghanapropertylisting.com in full against all claims by third parties which arise as a result of the user breaching his or her obligations under these terms and conditions or – contrary to this declaration – the user not owning all the rights to the content submitted or persons depicted not agreeing to its publication.
5. Responsibilities, duties and rights of the users
  1. The user undertakes not to violate applicable legal provisions and any contractual provisions when using the services of ghanapropertylisting.com. In particular, he/she undertakes to ensure that any content he/she distributes does not infringe the rights of third parties (e.g. copyrights, patent and trademark rights), that the applicable criminal laws and regulations for the protection of minors are observed and that no racist, grossly offensive, pornographic or sexual, youth-endangering, extremist, violence-glorifying or trivialising, war-glorifying or war-denying content is published, glorifying or trivialising violence, glorifying war, promoting a terrorist or extremist political organisation, inciting to commit a criminal offence, containing defamatory statements, insulting or unsuitable for minors or other punishable content. 
  2. In order to protect the data, the user further undertakes to comply with the recognised principles of data security and the obligation to observe the data protection regulations, to send any e-mails and queries to ghanapropertylisting.com for viruses, to comply with legal, official and technical regulations, to keep any user names and passwords secret, not to pass them on, not to tolerate or allow them to be read and to take the necessary measures to ensure confidentiality and to notify ghanapropertylisting.com immediately in the event of misuse or loss of this information or any suspicion thereof.
  3. Any indications of misuse of the content of ghanapropertylisting.com or of the payment system must also be reported to ghanapropertylisting.com without delay.

  6. The user may only offset claims of ghanapropertylisting.com against undisputed or legally binding claims. The user is only entitled to rights of retention on the basis of claims arising from the individual, specific contractual relationship of which these Terms and Conditions form an integral part.
6. Liability
  1. Liability of ghanapropertylisting.com as well as its representatives or vicarious agents for damages, in particular due to default, non-performance, defective performance or unlawful acts, shall only exist in the event of a breach of material contractual obligations, the performance of which could be particularly relied upon. 
  2. The exclusion of liability does not apply to intent and gross negligence. 
  3. In all other respects, liability on the part of ghanapropertylisting.com is excluded unless mandatory statutory provisions exist.
  4. ghanapropertylisting.com is only liable for foreseeable damage. 
  5. Liability for indirect damages, in particular consequential damages, unforeseeable damages or atypical damages as well as loss of profit is excluded. The same applies to the consequences of industrial disputes, accidental damage and force majeure.

  7. If ghanapropertylisting.com offers the possibility of submitting reviews, the comments made there by users are not checked by ghanapropertylisting.com; ghanapropertylisting.com does not adopt the opinions expressed there as its own. For this reason, ghanapropertylisting.com accepts no liability for the rating comments. The responsibility for all content that the user publishes on the pages of ghanapropertylisting.com lies solely with the user.
  8. ghanapropertylisting.com excludes all liability for technical or other malfunctions.
  9. The above limitations of liability apply to all contractual and non-contractual claims.
7. Cancellation / Termination of the Service
  1. The user and ghanapropertylisting.com are entitled to terminate a user account at any time with immediate effect and without stating reasons.

  3. In the event that your account is deleted, you may only regain access to the Services with the prior written consent of ghanapropertylisting.com
  4. ghanapropertylisting.com shall not be liable for any loss of your data.
8. Use / Rights of Use
  1. In order to enable ghanapropertylisting.com to make the information entered by users accessible and to ensure that the information is read as frequently as possible, ghanapropertylisting.com requires the following grant of rights of use:

9. No commercial use of the service

11. General publishing and listing requirements
  1. Users with the intention to publish, or list property(s), or have listed property(s), on ghanapropertylisting.com are required to adhere to the following principles:

(a) Legal and factual completeness and accuracy of data, offers and other information,

(b) Compliance with relevant legal provisions (e.g., consumer rights) in connection with the initiation and conclusion of your own contract with third parties,

(c) Only real estate properties that are available for purchase, rent, lease or rental on a temporary basis and are offered on the real estate market,

(d) Only properties from your own marketing portfolio or for which a direct marketing contract exists may be offered,

(e) The following objects may not be offered:

i. Holiday homes, and

ii. Properties abroad.

(f) It is not permitted to place several advertisements for the same property,

(g) For temporary rentals, a minimum rental period of one month applies,

(h) The account may not be shared by third parties,

(i) Property data in the form prepared by ghanapropertylisting.com may not be passed on to third parties,

(j) The property offers may not be overlaid by advertising representations of the company:

(k) Pictures must show the offered property or parts of it,

(l) Insertions (e.g. logos) must play a clearly subordinate role,

(m) Verbal representations of the company (e.g. references to websites) are prohibited.

(n) No false or incorrect information in the object address,

(o) No multiple entries of the same object,

(p) No unspecific or false information to entice interested parties,

(q) Information must be free of charge and may not contain hidden redirects to services for which a fee is charged,

(r) Type and prefabricated house offers, projected real estate projects and compulsory auctions must be marked as such,

(s) In the case of offers for which a commission is charged, this must be expressly mentioned and the amount of the commission stated,

(t) The user is responsible for ensuring that the transmitted files do not contain viruses or harmful programmes, and

(u) Objects that are no longer available must be deactivated.

12. Service Notifications
  1. In the event of important communications regarding a Service you are using, we will send you Service notifications and information that we are required to provide by law. 
  2. If you have provided us with your email address, we may send you service notifications by email, including to verify your identity prior to confirm your purchases. 
  3. We may also send you service notifications by other means. 
13. Termination of Services
  1. If your Services are terminated (either by you or by us), your right to access the Services will terminate immediately, as will your license to use the Services. And, we will delete any data or content associated with your Service or otherwise separate it from you (unless we are required by law to retain, return or transfer it to you or a third party designated by you).
  2. You may then no longer be able to access the Services (or your content that you have stored in those Services).
14. Service Availability
  1. The Services, may be unavailable from time to time, may be offered for a limited time, or may vary by region or device or by external factors, such as your Internet or network connection.
  2. We make every effort to keep the Services up and running. However, they are not provided with a guaranteed quality of service and all online services occasionally suffer disruptions and outages.
15. Payment Terms
  1. When you purchase a Service, these Terms apply, and you agree to these Terms.
  2. If a fee is charged for any portion of the Services, you agree to pay the fee. 
  3. The price quoted for the Services includes all applicable taxes unless otherwise stated. 
  4. You are solely responsible for payment of any such taxes or other charges. 
  5. Taxes are calculated based on location at the time you register your account, unless otherwise specified.
  6. After we notify you that we have not received a payment on time or in full, we may suspend or terminate the Services if you do not pay the full amount by the deadline set. 
  7. Suspension or termination of the Services due to non-payment may cause you to lose access to your account and its contents. 
  8. If you connect to the Internet through a corporate network or other private network that disguises your location, you may incur different charges than those shown for your actual location. Depending on your location, some transactions may require foreign currency conversion or be processed in another country.
  9. Your bank may charge additional fees for these services if you use a debit or credit card. Please check with your bank.
  10. To pay for a Service, you will be asked to provide a payment method when you sign up for the Service or at a later stage as applicable.
  11. You agree that ghanapropertylisting.com may use updated account information provided by your issuing bank or the applicable payment system, if applicable. 
  12. You agree to update your account and other information, including email address and payment method information, in a timely manner so that we can complete your transactions and contact you about your transactions as needed. 
  13. If you request us to stop using your payment method and do not provide us with a different payment method within a reasonable period of time upon our request, we may suspend or terminate your paid service for cause. A change to your Billing Account will not affect any charges made by us to your existing Billing Account until we have had a reasonable opportunity to act on that change.
16. Price Changes
  1. If your Service Offer has a fixed term and price, that price will apply for that term. 
  2. If you wish to continue using the Services thereafter, you must agree to a new offer and price. 
  3. If your Services are provided periodically and not for a fixed period of time (for example, monthly) and it is not a trial offer, we may change the price of the Services to reflect the increased cost of providing the Services, if we add new or improved Service features, or in response to market changes (for example, due to labour costs, currency fluctuations, changes in taxes/regulations, inflation, licence fees or infrastructure and administration costs). 
  4. We will notify you at least 30 days before the price change takes effect. When we notify you of a price change, we will also tell you the reasons for the price change and its extent and that the new price will take effect if you do not cancel the Services.
17. Refund Policy
  1. You may cancel – with or without cause – at any time.
  2. There will be no refund.Unless otherwise specified by law or by a particular service offering, all purchases are final and non-refundable.
18. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

19. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

20. Law and Jurisdiction

These terms and conditions and the relationship between you and ghanapropertylisting.com shall be governed by and construed in accordance with the Law of Ghana and ghanapropertylisting.com and you agree to submit to the exclusive jurisdiction of the Courts of Ghana.
